Terms of Use

These Terms of Use ("Terms") are a legal agreement between you ("User," "you") and MacroFanatic LLC ("MacroFanatic," "we," "us," "our"), the developer of the MacroFanatic mobile application (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal, non-commercial use. You may not:

  • Copy, modify, distribute, sell, or lease any part of the App;

  • Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by applicable law;

  • Use the App for any unlawful purpose or in violation of these Terms;

  • Remove, obscure, or alter any proprietary notices in the App.

This license is subject to the Apple Media Services Terms and Conditions / applicable app store terms, which take precedence in the event of a conflict regarding your right to use the App on an Apple device or Google device.

2. Description of Service

MacroFanatic is a calorie and nutrition tracking application that allows you to log food, scan barcodes, and use AI-assisted tools to identify nutrition information from photos of food packaging and nutrition labels.

3. Accounts

You must create an account to use most features of the App. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to promptly update it if it changes. We may suspend or terminate your account if we reasonably believe you have violated these Terms.

4. AI-Generated Content and Nutrition Data Disclaimer

MacroFanatic is not a medical device and does not provide medical advice. The App uses on-device optical character recognition (OCR) and artificial intelligence to read nutrition labels, product packaging, and barcodes and to estimate nutrition information. This process is automated and may produce inaccurate, incomplete, or outdated results, including but not limited to incorrect calorie counts, macronutrient values, ingredient lists, or allergen information.

Do not rely on AI-generated or OCR-extracted data for allergy avoidance, medical dietary restrictions, or any decision where inaccurate information could cause harm. Always verify nutrition and ingredient information directly against the physical product packaging before consuming any food, particularly if you have a food allergy, intolerance, or medical condition that requires precise dietary control.

The App is intended for general informational and fitness-tracking purposes only. Consult a physician, registered dietitian, or other qualified healthcare provider before making decisions about your diet, nutrition, or health, especially if you have or suspect you have a medical condition.

5. User-Generated and Community Content

The App allows users to contribute food and product information to a shared community database (e.g., by scanning and submitting new barcode entries). Community-submitted content is not independently verified by us before becoming available to other users. We do not guarantee the accuracy, completeness, or reliability of community-submitted content and are not liable for any reliance you place on it. We reserve the right to remove, edit, or reject any submitted content at our discretion, without notice.

6. Subscriptions

The App offers auto-renewable subscriptions that unlock premium features. If you purchase a subscription:

  • Payment will be charged to your Apple ID / Google Play account at confirmation of purchase.

  • Your subscription automatically renews for the same duration and price unless you turn off auto-renewal at least 24 hours before the end of the current period.

  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price then in effect.

  • You can manage or cancel your subscription at any time in your device's account settings (App Store or Google Play). Deleting the App does not cancel your subscription.

  • Current subscription plans, durations, and pricing are displayed in the App prior to purchase.

  • No refunds are provided by us directly for unused portions of a subscription period; refund requests are handled by Apple or Google in accordance with their respective policies.

7. Advertising

The free version of the App displays third-party advertising served through Google AdMob. Ad content is selected by our advertising partners and we do not control or endorse the products or services advertised. 8. Intellectual Property

The App, including its design, graphics, logos, and underlying software (excluding user-generated and community content), is owned by us or our licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

9. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms. You may stop using the App and delete your account at any time through the App's settings.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NUTRITION, PRODUCT, OR AI-GENERATED DATA WILL BE ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH, OR WELL-BEING, ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING RELIANCE ON ANY NUTRITION, ALLERGEN, OR PRODUCT INFORMATION PROVIDED THROUGH THE APP, WHETHER AI-GENERATED, OCR-EXTRACTED, OR COMMUNITY-SUBMITTED. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Minnesota, USA, without regard to conflict of law principles, unless otherwise required by the laws of your country of residence.
